Corruption in Higher Judiciary
« on: January 13, 2018, 11:15:23 AM »
Since I have joined profession I am raising this issue via this noble platform that there is huge corruption in Judiciary and now the four senior judges have brought this fact in public via press conference. I have observed that in courts the judges are asking irrelevant queries from new faces and deciding the cases according to their whims they are demoralizing the new faces and providing relief only to their known. Many of the judges are going to the extent of ignoring the binding judgments of the Apex Court in order to favour government. I am also Government Counsel and i know what is this. I have observed in ITAT also  members are upholding the reassessment on the basis of Market rates value of property, ignoring that Supreme Court in Dhariya Construction Hon'ble Apex Court has held that reopening on the basis of DVO report is not permissible. Now what a poor assessee will do the poor assessee is constrained to go the High Court and constrained to spend more money to settle the issue. But what about the member who has not followed the ruling, nothing. They are enjoying life. This fact has come to my knowledge while making head notes for TIOL. This is one example of corruption there are lot of other things which need improvements. Otherwise days are not far when there would be jungle Raaj in this Country and every body will take law in his hand. And we all know that criminal law is not meant for victims rather it is meant to facilitate criminals who can abolish any body for few penny. So Justice should be provided to known and unknown also in a proper manner this is my suggestion for the better administration of justice otherwise one day God will sit in the mind of some person and compel that person to take law in his hand and do justice in a criminal manner with these judges.
This would not be good for a civilized society

All content is read in this thread. It was a new knowledge for me. I see it as a really useful thing.
